Sem clareza sobre os par\u00e2metros t\u00e9cnicos de aferi\u00e7\u00e3o dos riscos psicossociais, qualquer equ\u00edvoco na aplica\u00e7\u00e3o trar\u00e1 consequ\u00eancias como infra\u00e7\u00f5es, penalidades e preju\u00edzos \u00e0s empresas.<\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 10.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #403e2c; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">Por se tratar de risco de alto car\u00e1ter subjetivo, n\u00e3o h\u00e1 a certeza sobre quais ser\u00e3o os crit\u00e9rios, utilizados pelos auditores, para avaliar a efic\u00e1cia das a\u00e7\u00f5es implementadas pelas empresas quanto aos fatores psicossociais relacionados ao trabalho, ou ainda de que tipo de evid\u00eancias a fiscaliza\u00e7\u00e3o utilizar\u00e1 para avaliar que uma empresa gerencia ou n\u00e3o esses fatores adequadamente.<\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 10.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #403e2c; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">Dentre os fatores de risco a serem gerenciados no ambiente do trabalho, o risco psicossocial \u00e9 considerado de natureza ergon\u00f4mica, sendo que o Manual de Interpreta\u00e7\u00e3o da NR-1, publicado em mar\u00e7o de 2026, indica que o foco \u00e9 a \u201corganiza\u00e7\u00e3o do trabalho, a forma como as tarefas e atividades s\u00e3o estruturadas, distribu\u00eddas e coordenadas dentro do ambiente de trabalho\u201d.\u00a0<\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 10.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #403e2c; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">Nesse contexto, a gest\u00e3o das empresas sobre fatores psicossociais do trabalho passar\u00e1 a ser auditada, conforme guia do MTE (2025), como:<\/span><\/p><ul type=\"disc\"><li style=\"color: #403e2c; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><i><span style=\"font-size: 10.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">baixo controle no trabalho\/falta de autonomia;<\/span><\/i><\/li><li style=\"color: #403e2c; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #403e2c; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">Risco para as MPEs<\/span><\/b><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 10.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #403e2c; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">A situa\u00e7\u00e3o \u00e9 ainda mais delicada para Micro e Pequenas Empresas (MPEs). Embora estejam dispensadas de elaborar o Programa de Gerenciamento de Riscos (PGR) de forma completa, se enquadradas nos graus de risco 1 e 2, continuam obrigadas a manter a Avalia\u00e7\u00e3o Ergon\u00f4mica Preliminar (AEP), alinhada com o Gerenciamento de Riscos Ocupacionais (GRO), o que implica lidar com os mesmos conceitos de riscos psicossociais que, neste momento, geram inseguran\u00e7a ao restante do setor produtivo.<\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 10.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #403e2c; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">O prazo adicional de 12 meses permitiria retomar o di\u00e1logo tripartite, estabelecer par\u00e2metros t\u00e9cnicos mais objetivos na pr\u00f3pria norma e dar aos neg\u00f3cios condi\u00e7\u00f5es reais de implementa\u00e7\u00e3o \u2014 sem o risco de autua\u00e7\u00f5es decorrentes de inseguran\u00e7a gerada pela aus\u00eancia de uma regulamenta\u00e7\u00e3o clara. Entretanto, at\u00e9 agora, o MTE n\u00e3o se posicionou favor\u00e1vel \u00e0 solicita\u00e7\u00e3o.\u00a0<\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 10.0pt; font-family: 'Arial',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: #403e2c; mso-font-kerning: 0pt; mso-ligatures: none; mso-fareast-language: PT-BR;\">Desde 2025, a FecomercioSP atua para garantir que o manual contemple as demandas empresariais e traga normas e conceitos objetivos, pr\u00e1ticos e poss\u00edveis de serem implementados.
