Todavia, nem sempre foi assim o entendimento do\nTST, que antes negava o direito sob o argumento jur\u00eddico da incompatibilidade\nda estabilidade com o regime de trabalho tempor\u00e1rio, pois j\u00e1 havia uma previs\u00e3o\ndo encerramento do contrato, descartando assim a hip\u00f3tese de dispensa\narbitr\u00e1ria.<o:p><\/o:p><\/span><\/p><p class=\"MsoNormal\" style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\">A partir de agora, se a gesta\u00e7\u00e3o ocorrer durante o\ncontrato tempor\u00e1rio, a trabalhadora passa a ter direito \u00e0 manuten\u00e7\u00e3o do v\u00ednculo\nou, caso o contrato acabe, ao pagamento de indeniza\u00e7\u00e3o substitutiva\ncorrespondente a todo o per\u00edodo de estabilidade, que dura at\u00e9 5 meses ap\u00f3s o\nparto.<o:p><\/o:p><\/span><\/p><p class=\"MsoNormal\" style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\">Significa que o risco para as empresas aumenta em\ncontrata\u00e7\u00f5es sazonais com altas de demanda ou substitui\u00e7\u00e3o de pessoal. A\nempresa de trabalho tempor\u00e1rio e a tomadora de servi\u00e7os, cuja responsabilidade\n\u00e9 solid\u00e1ria, precisam saber de que o encerramento do contrato n\u00e3o autoriza a\ndispensa da gestante sem os custos devidos, que inclui todos os sal\u00e1rios e seus\nreflexos, como f\u00e9rias proporcionais, d\u00e9cimo terceiro sal\u00e1rio e FGTS at\u00e9 o final\nda estabilidade provis\u00f3ria.<o:p><\/o:p><\/span><\/p><p class=\"MsoNormal\" style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\">A trabalhadora contratada temporariamente tamb\u00e9m\npassa a ter direito assegurado ao sal\u00e1rio-maternidade, pago pelo INSS,\npermanecendo na qualidade de segurada perante todo o per\u00edodo da estabilidade.<o:p><\/o:p><\/span><\/p><p class=\"MsoNormal\" style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\">Al\u00e9m disso, o fato de o empregador n\u00e3o ter\nconhecimento de que a trabalhadora estava gr\u00e1vida no momento da dispensa n\u00e3o\nafasta o dever de indenizar ou reintegrar na fun\u00e7\u00e3o anterior.<o:p><\/o:p><\/span><\/p><p class=\"MsoNormal\" style=\"text-align: justify;
