institui o sal\u00e1rio paternidade no \u00e2mbito da Previd\u00eancia Social; e altera a CLT, e as Leis n\u00bas 8.212\/91 (Lei Org\u00e2nica da Seguridade Social), 8.213\/91 (Lei de Benef\u00edcios da Previd\u00eancia Social), bem como a Lei 11.770\/2008, que disciplina o Programa Empresa Cidad\u00e3.<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">Conforme antes noticiado, muitos Projetos de Lei sobre o tema tramitaram no Congresso Nacional a partir da decis\u00e3o da Suprema Corte na A\u00e7\u00e3o Direta de Inconstitucionalidade por Omiss\u00e3o n\u00ba 20, na qual foi reconhecido a omiss\u00e3o do Legislativo Federal na regulamenta\u00e7\u00e3o do Par\u00e1grafo 1\u00ba, do art. 10 das Disposi\u00e7\u00f5es Constitucionais Transit\u00f3rias, que assim circularam desde a promulga\u00e7\u00e3o da Constitui\u00e7\u00e3o Federal em 1988:<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">O direito se aplica tanto no caso de nascimento de filhos biol\u00f3gicos como tamb\u00e9m na ado\u00e7\u00e3o ou guarda judicial de crian\u00e7a ou adolescente, sendo garantido ainda nos casos de parto antecipado e na hip\u00f3tese de falecimento da m\u00e3e.<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">Para fins de organiza\u00e7\u00e3o de escala, o empres\u00e1rio deve comunicar ao empregador, com pelo menos 30 dias de anteced\u00eancia, a data prevista para o in\u00edcio da licen\u00e7a, apresentando m\u00e9dico atestado com a previs\u00e3o do parto ou de certid\u00e3o da Vara da Inf\u00e2ncia e da Juventude. No caso de parto antecipado, o afastamento das atividades laborais \u00e9 imediato, devendo o empres\u00e1rio notificar o empregador o mais breve poss\u00edvel, apresentando seguir a documenta\u00e7\u00e3o que embasa a licen\u00e7a (certid\u00e3o de nascimento ou o termo judicial de guarda em caso de ado\u00e7\u00e3o).<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">&nbsp;O sal\u00e1rio-paternidade equivale aos sal\u00e1rios integrais do trabalhador nos dias de licen\u00e7a, devendo a parte vari\u00e1vel, ser calculado de acordo com a m\u00e9dia dos 6 (seis) \u00faltimos meses de trabalho, devendo ser pago diretamente pelo empregador mediante reembolso dos valores junto \u00e0 Previd\u00eancia, tal como ocorre na licen\u00e7a-maternidade. J\u00e1 no caso de empregados de Microempreendedores Individuais, o benef\u00edcio ser\u00e1 pago diretamente pela Previd\u00eancia Social ao trabalhador.<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">A lei confere garantia de emprego aos pais pelo per\u00edodo de um m\u00eas, contado do in\u00edcio da licen\u00e7a-paternidade, durante o qual o trabalhador n\u00e3o deve exercer qualquer atividade remunerada, devendo dedicar-se \u00e0 participa\u00e7\u00e3o nos cuidados e \u00e0 conviv\u00eancia com uma crian\u00e7a ou o adolescente.<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">A licen\u00e7a-paternidade poder\u00e1 ser suspensa, cessada ou indeferida, quando houver elementos concretos que indiquem viol\u00eancia dom\u00e9stica ou familiar, bem como de abandono material do pai em rela\u00e7\u00e3o \u00e0 crian\u00e7a ou ao adolescente sob sua responsabilidade, situa\u00e7\u00e3o que depende ainda do Decreto Regulamentador.<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\">&nbsp;<o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">Durante toda a tramita\u00e7\u00e3o do tema no Legislativo Federal foi levada informa\u00e7\u00e3o sobre os impactos que uma amplia\u00e7\u00e3o excessiva e obrigat\u00f3ria da dura\u00e7\u00e3o da licen\u00e7a paternidade poderia trazer \u00e0s empresas do Pa\u00eds, especialmente para as pequenas, justamente as respons\u00e1veis pela maior parte da ocupa\u00e7\u00e3o formal. Foi esclarecido ao Legislativo que 60% dessas empresas contam com at\u00e9 quatro funcion\u00e1rios e que a aus\u00eancia de apenas um colaborador, representa a perda imediata de 20% a 50% da for\u00e7a produtiva, sendo que a melhor solu\u00e7\u00e3o para a amplia\u00e7\u00e3o da licen\u00e7a seria a negocia\u00e7\u00e3o coletiva.<\/font><\/font><o:p><\/o:p><\/span><\/p><p style=\"text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size:10.0pt;font-family:\n&quot;Arial&quot;,sans-serif;mso-fareast-font-family:&quot;Times New Roman&quot;;color:#403E2C;\nmso-fareast-language:PT-BR\"><font dir=\"auto\" style=\"vertical-align: inherit;\"><font dir=\"auto\" style=\"vertical-align: inherit;\">A atua\u00e7\u00e3o junto ao Parlamento foi fundamental para que propostas legislativas prevendo per\u00edodos de at\u00e9 120\/180 dias afastados e para garantir que a amplia\u00e7\u00e3o fosse feita gradualmente ao longo de tr\u00eas anos, ou que fosse atendida. Com a participa\u00e7\u00e3o do sistema sindical do Com\u00e9rcio em rede, onde a Federa\u00e7\u00e3o e os Sindicatos filiados mobilizaram parlamentares para que a licen\u00e7a de 30 dias, a proposta inicialmente na C\u00e2mara fosse modificada, sendo poss\u00edvel, assim, mitigar os efeitos da mudan\u00e7a inovadora.
